Legal Bases for the Processing
Below you will find an overview of thelegal basis of the GDPR on the basis of which we process personal data. Pleasenote that in addition to the provisions of the GDPR, national data protectionregulations may apply in your or our country of residence or domicile. If, inaddition, more specific legal bases are applicable in individual cases, we willinform you of these in the data protection declaration.
Consent (Article 6 (1) (a) GDPR) - The data subject has given consent to the processing of his or her personal data for one or more specific purposes.
Performance of a contract and prior requests (Article 6 (1) (b) GDPR) - Performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
Compliance with a legal obligation (Article 6 (1) (c) GDPR) - Processing is necessary for compliance with a legal obligation to which the controller is subject.
Legitimate Interests (Article 6 (1) (f) GDPR) - Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.
In addition to the data protectionregulations of the GDPR, national regulations apply to data protection inAustria. This includes in particular the Federal Act on the Protection ofIndividuals with regard to the Processing of Personal Data (Data Protection Act- DSG). In particular, the Data Protection Act contains special provisions onthe right of access, rectification or cancellation, processing of specialcategories of personal data, processing for other purposes and transmission andautomated decision making in individual cases.
Security Precautions
We take appropriate technical andorganisational measures in accordance with the legal requirements, taking intoaccount the state of the art, the costs of implementation and the nature,scope, context and purposes of processing as well as the risk of varyinglikelihood and severity for the rights and freedoms of natural persons, inorder to ensure a level of security appropriate to the risk.
The measures include, in particular,safeguarding the confidentiality, integrity and availability of data bycontrolling physical and electronic access to the data as well as access to,input, transmission, securing and separation of the data. In addition, we haveestablished procedures to ensure that data subjects' rights are respected, thatdata is erased, and that we are prepared to respond to data threats rapidly.Furthermore, we take the protection of personal data into account as early asthe development or selection of hardware, software and service providers, inaccordance with the principle of privacy by design and privacy by default.
Transmission of Personal Data
In the context of our processing ofpersonal data, it may happen that the data is transferred to other places,companies or persons or that it is disclosed to them. Recipients of this datamay include, for example, service providers commissioned with IT tasks orproviders of services and content that are embedded in a website. In such cases,the legal requirements will be respected and in particular correspondingcontracts or agreements, which serve the protection of your data, will beconcluded with the recipients of your data.
Data Processing in Third Countries
If we process data in a third country (i.e.outside the European Union (EU), the European Economic Area (EEA)) or theprocessing takes place in the context of the use of third party services ordisclosure or transfer of data to other persons, bodies or companies, this willonly take place in accordance with the legal requirements.
Subject to express consent or transferrequired by contract or law, we process or have processed the data only inthird countries with a recognised level of data protection, on the basis ofspecial guarantees, such as a contractual obligation through so-called standardprotection clauses of the EU Commission or if certifications or bindinginternal data protection regulations justify the processing (Article 44 to 49GDPR, information page of the EU Commission: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection_en).
Erasure of data
The data processed by us will be erased inaccordance with the statutory provisions as soon as their processing is revokedor other permissions no longer apply (e.g. if the purpose of processing thisdata no longer applies or they are not required for the purpose). If the datais not deleted because they are required for other and legally permissiblepurposes, their processing is limited to these purposes. This means that thedata will be restricted and not processed for other purposes. This applies, forexample, to data that must be stored for commercial or tax reasons or for whichstorage is necessary to assert, exercise or defend legal claims or to protectthe rights of another natural or legal person. Our further information onindividual processing operations may also contain additional and specificinformation on data retention and erasure applicable to the respectiveprocessing operations.
Use of Cookies
Cookies are small text files or other datarecords that store information on end devices and read information from the enddevices. For example, to store the login status in a user account, the contentsof a shopping cart in an e-shop, the contents accessed or the functions used.Cookies can also be used for various purposes, e.g. for purposes offunctionality, security and convenience of online offers as well as thecreation of analyses of visitor flows.
Information on consent: We use cookies in accordance with the statutory provisions.Therefore, we obtain prior consent from users, except when it is not requiredby law. In particular, consent is not required if the storage and reading ofinformation, including cookies, is strictly necessary in order to provide aninformation society service explicitly requested by the subscriber or user. Essentialcookies usually include cookies with functions related to the display andoperability of the onlineservice, load balancing, security, storage of users'preferences and choices or similar purposes related to the provision of themain and secondary functions of the onlineservice requested by users. Therevocable consent will be clearly communicated to the user and will contain theinformation on the respective cookie use.
Information on legal bases under dataprotection law: The legal basis under data protectionlaw on which we process users' personal data with the use of cookies depends onwhether we ask users for consent. If users consent, the legal basis forprocessing their data is their declared consent. Otherwise, the data processedwith the help of cookies is processed on the basis of our legitimate interests(e.g. in a business operation of our online services and improvement of itsusability) or, if this is done in the context of the fulfillment of ourcontractual obligations, if the use of cookies is necessary to fulfill ourcontractual obligations. For which purposes the cookies are processed by us, wedo clarify in the course of this privacy policy or in the context of ourconsent and processing procedures.
Retention period: With regard to the retention period, a distinction is drawn betweenthe following types of cookies:
Temporary cookies (also known as "session cookies"): Temporary cookies are deleted at the latest after a user has left an online service and closed his or her end device (i.e. browser or mobile application).
Permanent cookies: Permanent cookies remain stored even after the terminal device is closed. For example, the login status can be saved, or preferred content can be displayed directly when the user visits a website again. Likewise, user data collected with the help of cookies can be used for reach measurement. Unless we provide users with explicit information about the type and storage duration of cookies (e.g., as part of obtaining consent), users should assume that cookies are permanent and that the storage period can be up to two years.
General information on revocation andobjection (opt-out): Users can revoke the consentthey have given at any time and also file an objection to processing inaccordance with the legal requirements in Article 21 GDPR. Users can alsodeclare their objection by means of the settings of their browser, e.g. bydeactivating the use of cookies (whereby this may also limit the functionalityof our online services). Processing Cookie Data on the Basis of Consent: We use a cookie management solution in which users' consent to the use of cookies, or the procedures and providers mentioned in the cookie management solution, can be obtained, managed and revoked by the users. The declaration of consent is stored so that it does not have to be retrieved again and the consent can be proven in accordance with the legal obligation. Storage can take place server-sided and/or in a cookie (so-called opt-out cookie or with the aid of comparable technologies) in order to be able to assign the consent to a user or and/or his/her device. Subject to individual details of the providers of cookie management services, the following information applies: The duration of the storage of the consent can be up to two years. Business services
We process data of our contractual andbusiness partners, e.g. customers and interested parties (collectively referredto as "contractual partners") within the context of contractual andcomparable legal relationships as well as associated actions and communicationwith the contractual partners or pre-contractually, e.g. to answer inquiries.
We process this data in order to fulfillour contractual obligations. These include, in particular, the obligations toprovide the agreed services, any update obligations and remedies in the eventof warranty and other service disruptions. In addition, we process the data toprotect our rights and for the purpose of administrative tasks associated withthese obligations and company organization. Furthermore, we process the data onthe basis of our legitimate interests in proper and economical businessmanagement as well as security measures to protect our contractual partners andour business operations from misuse, endangerment of their data, secrets,information and rights (e.g. for the involvement of telecommunications,transport and other auxiliary services as well as subcontractors, banks, taxand legal advisors, payment service providers or tax authorities). Within theframework of applicable law, we only disclose the data of contractual partnersto third parties to the extent that this is necessary for the aforementionedpurposes or to fulfill legal obligations. Contractual partners will be informedabout further forms of processing, e.g. for marketing purposes, within thescope of this privacy policy.
Which data are necessary for theaforementioned purposes, we inform the contracting partners before or in thecontext of the data collection, e.g. in online forms by special marking (e.g.colors), and/or symbols (e.g. asterisks or the like), or personally.
We delete the data after expiry ofstatutory warranty and comparable obligations, i.e. in principle after expiryof 4 years, unless the data is stored in a customer account or must be kept forlegal reasons of archiving. The statutory retention period for documentsrelevant under tax law as well as for commercial books, inventories, openingbalance sheets, annual financial statements, the instructions required tounderstand these documents and other organizational documents and accountingrecords is ten years and for received commercial and business letters andreproductions of sent commercial and business letters six years. The periodbegins at the end of the calendar year in which the last entry was made in thebook, the inventory, the opening balance sheet, the annual financial statementsor the management report was prepared, the commercial or business letter wasreceived or sent, or the accounting document was created, furthermore therecord was made or the other documents were created.
If we use third-party providers orplatforms to provide our services, the terms and conditions and privacypolicies of the respective third-party providers or platforms shall apply inthe relationship between the users and the providers.

We process user data in order to be able toprovide them with our online services. For this purpose, we process the IPaddress of the user, which is necessary to transmit the content and functionsof our online services to the user's browser or terminal device.

Provision of online offer on rented hosting space: For the provision of our online services, we use storage space, computing capacity and software that we rent or otherwise obtain from a corresponding server provider (also referred to as a "web hoster"); Legal Basis: Legitimate Interests (Article 6 (1) (f) GDPR).
E-mail Sending and Hosting: The web hosting services we use also include sending, receiving and storing e-mails. For these purposes, the addresses of the recipients and senders, as well as other information relating to the sending of e-mails (e.g. the providers involved) and the contents of the respective e-mails are processed. The above data may also be processed for SPAM detection purposes. Please note that e-mails on the Internet are generally not sent in encrypted form. As a rule, e-mails are encrypted during transport, but not on the servers from which they are sent and received (unless a so-called end-to-end encryption method is used). Content-Delivery-Network: We use a so-called "Content Delivery Network" (CDN). Cloud Services
We use Internet-accessible softwareservices (so-called "cloud services", also referred to as"Software as a Service") provided on the servers of its providers forthe storage and management of content (e.g. document storage and management,exchange of documents, content and information with certain recipients orpublication of content and information).
Within this framework, personal data may beprocessed and stored on the provider's servers insofar as this data is part ofcommunication processes with us or is otherwise processed by us in accordancewith this privacy policy. This data may include in particular master data andcontact data of data subjects, data on processes, contracts, other proceedingsand their contents. Web analysis is used to evaluate thevisitor traffic on our website and may include the behaviour, interests ordemographic information of users, such as age or gender, as pseudonymousvalues. With the help of web analysis we can e.g. recognize, at which time ouronline services or their functions or contents are most frequently used orrequested for repeatedly, as well as which areas require optimization.
In addition to web analysis, we can alsouse test procedures, e.g. to test and optimize different versions of our onlineservices or their components.
Unless otherwise stated below, profiles,i.e. data aggregated for a usage process, can be created for these purposes andinformation can be stored in a browser or in a terminal device and read fromit. The information collected includes, in particular, websites visited andelements used there as well as technical information such as the browser used,the computer system used and information on usage times. If users have agreedto the collection of their location data from us or from the providers of theservices we use, location data may also be processed.
Unless otherwise stated below, profiles,that is data summarized for a usage process or user, may be created for thesepurposes and stored in a browser or terminal device (so-called"cookies") or similar processes may be used for the same purpose. Theinformation collected includes, in particular, websites visited and elementsused there as well as technical information such as the browser used, thecomputer system used and information on usage times. If users have consented tothe collection of their location data or profiles to us or to the providers ofthe services we use, these may also be processed, depending on the provider.
The IP addresses of the users are alsostored. However, we use any existing IP masking procedure (i.e.pseudonymisation by shortening the IP address) to protect the user. In general,within the framework of web analysis, A/B testing and optimisation, no userdata (such as e-mail addresses or names) is stored, but pseudonyms. This meansthat we, as well as the providers of the software used, do not know the actualidentity of the users, but only the information stored in their profiles forthe purposes of the respective processes.
Notes on legal bases: If we ask users fortheir consent to use third-party providers, the legal basis for data processingis consent. Otherwise, user data will be processed on the basis of ourlegitimate interests (i.e. interest in efficient, economical and recipient-friendlyservices). Affiliate-Programms and Affiliate-Links
Within our online services, we includeso-called affiliate links or other references (which for example may include searchforms, widgets or discount codes) to the offers and services of third parties(collectively referred to as "affiliate links"). When users followaffiliate links or subsequently take advantage of offers, we may receivecommission or other benefits (collectively referred to as"commission") from these third parties.
In order to be able to track whether theusers have followed the offers of an affiliate link used by us, it is necessaryfor the respective third party to know that the users have followed anaffiliate link used within our online services. The assignment of affiliatelinks to the respective business transactions or other actions (e.g.,purchases) serves the sole purpose of commission settlement and is removed assoon as it is no longer required for this purpose.

Profiles in Social Networks (Social Media)
We maintain online presences within socialnetworks and process user data in this context in order to communicate with theusers active there or to offer information about us.
We would like to point out that user datamay be processed outside the European Union. This may entail risks for users,e.g. by making it more difficult to enforce users' rights.
In addition, user data is usually processedwithin social networks for market research and advertising purposes. Forexample, user profiles can be created on the basis of user behaviour and theassociated interests of users. The user profiles can then be used, for example,to place advertisements within and outside the networks which are presumed tocorrespond to the interests of the users. For these purposes, cookies areusually stored on the user's computer, in which the user's usage behaviour andinterests are stored. Furthermore, data can be stored in the user profilesindependently of the devices used by the users (especially if the users aremembers of the respective networks or will become members later on).

Also in the case of requests forinformation and the exercise of rights of data subjects, we point out thatthese can be most effectively pursued with the providers.
